A person may disclose protected information if the disclosure is made [s60 (2)]:

  • for the purposes of the NDIS;
  • with the express or implied authorisation of the participant;
  • for the purposes for which the disclosure was made; or
  • to prevent or lessen a serious threat to a person’s life, health or safety.

Disclosure for the purposes of the Act includes disclosure for research into the NDIS, actuarial analysis of the NDIS or policy development. [s60 (3)]
