In the NDIS Act, protected information refers to information about a person that is or was held in the records of the Agency or information to the effect that the Agency holds no record of a person. [s9]

Protected information provided by a participant to the Agency through the participant’s engagement with the NDIS is private with certain exceptions. Disclosure of information not provided for by a relevant exception is an offence under the Act. [ss6164]

The operation of the Freedom of Information Act 1982 is not affected by the provisions of the NDIS Act. [s68]
